Birth Certificate Registration

A child born in the United States of an Ecuadorian citizen is eligible for dual citizenship and may enjoy the benefits of Ecuadorian as well as American nationality by getting registered at the nearest Ecuadorian Consulate.

To register the birth of a child to an Ecuadorian father or mother, the following is required:

  1. The original birth certificate, or a certified copy of the minor. (The legalization cost is US$ 10.00 dollars)
  2. Translation into Spanish of the original birth certificate duly notarized. (The legalization cost is US$ 10.00 dollars) Optional.
  3. Identification from both parents. For the Ecuadorian parent it can be the passport or Ecuadorian ID called "Cédula"; for a foreign parent it can be a passport, for US citizens it can also be a current driver's license.
  4. If the parents of the child are not married, both of them will have to appear in the consulate for the registration process.
  5. The registration can also be done by grandfathers, sibling's over 18 years of age or other family members

The registration is free of charge if performed before the child's 18th birthday.

If 18 years have elapsed from the date of birth, the cost for the late registration is US$ 30.00.

The Consulate will mail the birth registration to the Office of the National Civil Registry of Ecuador for the permanent birth registration.

The interested party may request a birth certificate and the Ecuadorian ID called "Cédula" at the Office of the National Civil Registry of Ecuador about three months after the registration was sent to Ecuador. All registration in this office are DEFINITIVE.

Marriage Registration

Ecuadorian law applies to Ecuadorians wherever they reside.

Therefore, a change in civil status such as marriage or divorce has to be registered by the Consulate.

The marriage of Ecuadorians between Ecuadorians and foreigners or to foreigners residing overseas can be performed at the office of Ecuadorian Consulates, where the registration and ceremony take place and is valid in Ecuador (Cost US$ 60.00). The marriage can also take place before foreign authorities and in this case, to have validity in Ecuador, one must present proper documentation at an Ecuadorian Consulate.

Marriage registration requirements:

  1. The original marriage certificate or license issued by the proper civil authority. (Legalization cost US$ 10,00)
  2. Certificate of marriage or license translated into Spanish, notarized. (Legalization cost US$ 10.00)

Beginning June 1, 2000, the Ecuadorian Consulate is not permitted by Law to register the marriages held overseas, the Ecuadorian Consulates will limit their duties to legalize proper documentation and the interested party must register the marriage once he or she has arrived to Ecuador at the Civil Registry Office.

Once it is registered, the consulate will send the certificate to the Headquarters of the Civil Registry in Ecuador for its permanent record.

Divorce Registration

In accordance with Ecuadorian legislation the termination of a marriage occurs by:

  1. Death of one of the spouses
  2. Executed sentence that decrees the nullity of the marriage
  3. Executed sentence that decreed the provides the effective possession of the state of the missing spouse

In order for a divorce executed in foreign soil to be accepted, the interested party must follow a trail of recognition of a foreign sentence or otherwise initiate a divorce trial before a civil law Ecuadorian judge.

To file a divorce in Ecuador, it is required:

  1. If the divorce is of mutual agreement, which includes child's custody or properties settlement, one or both of the parties must grant a joint Power of Attorney for divorce to a lawyer or a relative in Ecuador. (Fee for the power of attorney is US$ 80.00)
  2. If the couple has been previously divorced in a country other than Ecuador, it is important to send the corresponding papers with the Power of Attorney, authenticated by the Consulate. (Cost is US$ 10.00) This document must be accompanied by the translation into Spanish, also notarized and legalized in the Consulate. (Cost is US$ 10.00) This procedure will need the Lawyer to accelerate the process.

Death Registration

Requirements to register a death of an Ecuadorian in a foreign territory:

  1. Original death certificate and notarized translation into Spanish (Cost of the legalization US$ 10 dollars each)
  2. Embalmment certificate and notarized translation into Spanish (Cost of the legalization US$ 10 dollars each)
  3. Certificate of communicable disease and notarized translation into Spanish (Cost of the legalization US$ 10 dollars each)
  4. Burial Transit Permit and notarized translation into Spanish (Cost of the legalization US$ 10 dollars each)
  5. The identification of the person who requests the registration.
  6. Ecuadorian identification from the deceased.
  7. The registration fee is $20.00 if the registration is performed after 48 hours of the incident.

Once the registration has been processed, the Consulate will mail the registration certificate to the National Civil Registry through the Ministry of Foreign Affairs for its permanent record.
